Terms of service
Kitted Audio
Website Terms & Conditions
Version 1.0 • Effective date: 27 October 2026
Please read these terms before ordering. Check vehicle fitment before installation (clause 4). Incorrect installation or misuse can cause injury, vehicle damage or equipment failure and may affect a claim where it caused the problem (clauses 11 and 14). Cancellation rights differ for ordinary and genuinely customised goods (clauses 8 and 12). Returns may be checked against our serial-number and dispatch records (clause 15). Clause 19 limits certain claims by business purchasers outside statutory consumer-contract protection. None of these provisions removes a consumer right that the law does not allow us to exclude.
1. Who you are buying from
1.1 Kitted Audio, a sole proprietorship (we, us or our), operates kittedaudio.co.za. Our company and contact details appear in clause 24. You are the person or business placing an order.
1.2 We sell car-audio equipment, vehicle electronics, fitment accessories and the other products expressly offered on our website. These terms cover website use and purchases for delivery within South Africa. They do not appoint us as your importing, customs-clearing or freight-forwarding agent.
1.3 Your sale is with us, even where a supplier dispatches the goods or another business assists with fulfilment. Our website platform, payment providers, suppliers and couriers do not replace us as the seller. Installation is not included unless expressly stated in the accepted order.
2. The agreement and your legal rights
2.1 The agreement consists of these terms, the product description and any specific conditions disclosed before you order, together with the order we accept. A specific condition takes precedence only on the subject it expressly addresses and only where lawful. New conditions on an invoice or delivery note do not change an existing agreement without your agreement.
2.2 The Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and other applicable laws take precedence over any inconsistent term. The rights described here apply where the relevant legislation covers your transaction. Buying through a business or using a business invoice does not, by itself, remove consumer protection.
2.3 “Business day” means a day other than a Saturday, Sunday or South African public holiday. Other references to days mean calendar days. Written communications include email and messages sent through our published business messaging channels that can be saved and reproduced.
3. Using the website and placing an order
3.1 You must have legal capacity to contract. A person ordering for a business must have authority to bind it. Give accurate contact, billing and delivery details and correct mistakes promptly.
3.2 Keep account credentials and collection codes secure and tell us promptly about suspected unauthorised use. We may carry out proportionate identity and payment checks. We will not request your banking password, card PIN or one-time banking password by email or WhatsApp.
3.3 Do not use the website for fraud, unlawful transactions, malicious software, unauthorised access or activity that materially interferes with its operation. We may restrict access where reasonably necessary to address these risks. This does not forfeit money we owe you or prevent a legitimate return or complaint.
3.4 We take reasonable steps to maintain the website but do not promise uninterrupted access. A website outage does not extinguish an accepted order or an existing claim.
4. Products, specifications and vehicle compatibility
4.1 Read the product description, model number, dimensions, specifications and included accessories before ordering. Images show the product’s general appearance; the description identifies what is supplied. The goods supplied must match the agreed description. Goods are new unless a different condition is expressly disclosed before purchase.
4.2 Vehicle make and year alone may not establish compatibility. Different trim levels, factory amplifiers, dashboard layouts, connectors and vehicle systems may require different equipment. Before ordering, check the exact fitment or ask us for assistance, supplying the relevant vehicle and existing-system details. Check the goods before cutting, wiring, coding or installing them.
4.3 Fascia panels, aerial adapters, wiring harnesses, CAN-bus interfaces, fitting kits, coding and installation labour are included only where expressly listed. Descriptions such as “OEM-style” or “vehicle-specific” do not mean that a product was manufactured or endorsed by the vehicle manufacturer.
4.4 Where you disclose a particular purpose or vehicle configuration and reasonably rely on our recommendation, we remain responsible for that recommendation to the extent required by law. A fitment guide is not an exclusion of responsibility for an inaccurate description or advice we give.
4.5 Compatibility with phones, applications and software is as described at the time of sale. Unless expressly promised, we do not guarantee support for every future third-party update. This does not excuse a missing advertised feature, a defect or any support obligation imposed by law.
5. When an order becomes binding
5.1 Before submitting an order you must be able to review the goods, quantities, delivery details and total price, correct errors and withdraw. Submitting the order is your offer to purchase on the terms presented.
5.2 An automated acknowledgement or payment confirmation is not, by itself, acceptance. We accept an order when we expressly confirm acceptance or dispatch the goods, whichever occurs first. We will check payment and availability promptly and tell you whether the order has been accepted or requires your further agreement.
5.3 Before acceptance, we may decline an order on reasonable grounds, including unavailable stock, an unresolved payment issue or substantiated fraud concerns, subject to applicable law. Any payment for a declined order will be refunded promptly. We cannot use this clause to avoid an already binding sale or mandatory stock-availability obligations.
5.4 After acceptance, changes require agreement unless these terms or the law permit cancellation. A change to the product, quantity, price or delivery arrangement will be explained before you are asked to accept it.
6. Prices and stock availability
6.1 Prices are in South African rand. Displayed consumer prices include VAT where payable. Delivery charges and any other amount payable to us will be disclosed before you submit the order. We do not add undisclosed import duties, handling charges or payment fees afterwards.
6.2 Prices may change for future orders. An obvious listing or pricing error will be addressed promptly and in accordance with applicable law; it does not give us an unrestricted right to cancel an accepted order or demand a higher price.
6.3 Some products are held by us and others are obtained from suppliers. We will distinguish available stock from pre-orders or backorders and disclose the relevant lead time before purchase. A supplier catalogue is not a promise that every listed item is immediately available.
6.4 If an ordered product is unavailable, we will notify you promptly. You may agree to a revised lead time or a specified alternative; otherwise we will cancel the unavailable supply and refund the relevant payment. We will not substitute a different brand or model, issue compulsory store credit or place you on an indefinite backorder. Your additional rights concerning overselling or non-performance remain intact.
7. Payment and ownership
7.1 Use only the payment methods enabled at checkout or confirmed through our official channels. Unless a different arrangement is agreed, payment must be verified before dispatch. A payment screenshot alone is not proof that funds have cleared. Confirm any purported change to bank details using our independently verified business contact number.
7.2 Where an instalment or buy-now-pay-later option is available, approval and the separate payment arrangement are governed by the provider’s terms disclosed to you. We remain responsible for the sale and its applicable return and refund obligations. A return will be coordinated with the provider so that the payment arrangement is adjusted as required; provider approval does not replace your rights against us.
7.3 Ownership passes once the goods have been delivered and the purchase price has been paid to us, including through an approved payment provider. We do not retain ownership merely because you still owe instalments to that provider. Risk is dealt with separately in clause 9.
7.4 Nothing prevents a genuine payment dispute or lawful chargeback. You may not retain a duplicate refund for the same payment. Suspected unauthorised payments will be investigated reasonably, without imposing a blanket forfeiture of customer funds.
8. Pre-orders, customised goods and early cancellation
8.1 For a pre-order, special order or customised product, we will disclose the specification, price, required deposit, expected dispatch and delivery period, and any special cancellation condition before you commit. Custom work will begin only after you approve the specification and authorise it.
8.2 A standard product does not become non-returnable merely because we order it from a supplier, import it or describe it as a “special order”. Goods genuinely made to your specifications or clearly personalised may be excluded from ECTA’s ordinary cooling-off right, as explained in clause 12. Defect and misdescription rights still apply.
8.3 Contact us as soon as you need to cancel. An order withdrawn before our acceptance will be refunded without a cancellation penalty. After acceptance, applicable cooling-off and cancellation rights take precedence. Where a cancellation charge is legally permissible, it must be reasonable, supported by the circumstances and consistent with any condition disclosed before the order; a deposit is not automatically forfeited in full.
8.4 After dispatch, cancellation may require return of the goods under clauses 12 to 16. A cancellation request does not authorise continued use of goods that must be returned.
9. Delivery, collection and risk
9.1 Available delivery methods, service areas, charges and the dispatch and delivery timeframe will be shown before purchase. Locker delivery is available only for eligible parcels and locations. Collection is available only where offered and after we confirm that the order is ready. Delivery estimates do not remove a binding delivery commitment or a statutory right.
9.2 Where ECTA applies, we must execute the order within 30 days after receiving it unless another period has been agreed. If we fail to execute it within that period or the agreed period, you may cancel on seven days’ written notice under ECTA. Any more favourable cancellation right under the CPA or another applicable law remains available. If the goods are unavailable, we will notify you immediately and refund the relevant payment within 30 days of that notification, or sooner where required.
9.3 Give a complete, accessible delivery address and a working contact number. Where your incorrect instructions or failure to collect causes a repeat delivery, we may recover reasonable additional delivery costs disclosed to you before the repeat service is agreed. We do not charge you for a failed delivery caused by us or our courier. An uncollected parcel is not automatically abandoned and your payment is not automatically forfeited.
9.4 Goods sent through our delivery arrangements remain at our risk until you or your authorised recipient takes delivery. Handover to our courier is not delivery to you. For locker deliveries, risk passes on collection by you or your authorised recipient, not merely when the parcel is placed in the locker. We will investigate courier loss or damage and provide the remedy required by law without making you first recover from the courier.
9.5 We will not split an order or impose extra delivery charges for separate parcels without disclosing the arrangement and obtaining any consent required by law. Signing for a parcel confirms receipt, not that concealed defects or missing contents have been waived.
10. Dispatch checks and receiving your goods
10.1 We may inspect, photograph, record serial numbers and, where appropriate, test goods before dispatch. Packaging may be opened for these checks. Any goods supplied as used, refurbished or demonstration stock will be identified as such before purchase. Where a product has a serial number, we will record it on the invoice or dispatch record.
10.2 Check the model, serial number, accessories and visible condition on receipt. Please report visible damage, shortages or an incorrect item within two business days, with photographs where reasonably available, so that we can investigate promptly. This is a request for prompt reporting, not a deadline that extinguishes statutory rights.
10.3 Keep protective packaging while checking the order. A dispatch photograph, successful test, delivery signature, missing unboxing video or failure to notice a concealed defect does not, by itself, defeat a legitimate claim.
11. Installation and safe use
11.1 Electrical and audio equipment can cause injury, fire, vehicle damage or equipment failure if incorrectly installed or used. Follow the product and vehicle manufacturers’ instructions and use a competent installer where specialist work is required. Before installation, verify the model, fitment, wiring, voltage, load and other relevant specifications.
11.2 Do not bypass safety interlocks or use screens or controls in a way that compromises lawful, safe driving. Stop using equipment that appears unsafe and contact us. Do not continue operating a faulty product where doing so may cause further damage.
11.3 We are not responsible for the separate work of an independent installer you appoint merely because we supplied the product. This does not exclude responsibility for our own installation work, advice, defective goods or other liability imposed by law. Use of an independent installer does not, on its own, invalidate a warranty.
11.4 For a discretionary change-of-mind return, we do not ordinarily reimburse independent installation or removal costs. This does not exclude a properly established claim for those costs arising from our breach, defective goods or another legal entitlement.
12. Change of mind, incorrect selection and cooling-off
12.1 Where section 44 of ECTA applies, you may cancel an electronic purchase without giving a reason and without penalty within seven days after receiving the goods. This statutory right applies to qualifying natural-person end users, subject to the Act’s exclusions. Send a clear cancellation notice to the email or business messaging contact in clause 24 within that period.
12.2 For that cancellation, the only charge we may levy is the direct cost of returning the goods. We will refund your payment in full within 30 days after cancellation, including the original delivery payment where the whole order is cancelled. We will not deduct a restocking, administration, card-processing or instalment-provider fee from this statutory refund.
12.3 Return the goods promptly with the supplied accessories, reasonably protected for transport. We will provide practical return instructions. The right to cancel is not a right to keep the goods and receive a refund. Opening ordinary product packaging does not automatically remove the cooling-off right. Any separate claim about customer-caused damage must have a lawful basis and is not an automatic cancellation penalty.
12.4 The cooling-off right does not apply where ECTA expressly excludes it, including to goods made to your specifications or clearly personalised. We will identify an applicable exclusion before purchase. Ordinary car-audio hardware is not excluded simply because it is electronic equipment. An exclusion from cooling-off does not exclude remedies for defective, unsafe, incorrect or misdescribed goods.
12.5 Outside a statutory right or a more favourable return offer expressly published for the product, we do not offer an unconditional change-of-mind return or exchange. We may agree to a discretionary exchange on written conditions disclosed beforehand. Ordering the wrong item does not itself make the item defective, but it does not remove an applicable cooling-off or suitability right.
12.6 Other statutory cancellation rights remain available. These include any applicable direct-marketing cooling-off right and the cancellation right arising from non-compliance with ECTA’s required transaction disclosures and checkout procedures.
13. Incorrect, unsuitable, damaged or defective goods
13.1 If we supply the wrong product, omit an included item, or deliver damaged or misdescribed goods, contact us promptly. Do not install an item you know to be incorrect. We will arrange the appropriate collection and remedy at our cost where we are responsible, without treating our mistake as your change of mind.
13.2 Where section 20 of the CPA applies to goods unsuitable for a particular purpose disclosed to us, those goods may be returned within 10 business days after delivery, subject to that section’s conditions and permitted adjustments. The return is at our risk and expense. Restrictions specific to that right, including for certain altered or installed goods, do not automatically remove separate defect or warranty rights.
13.3 Where section 56 of the CPA applies, goods that fail to meet the statutory quality, safety or suitability requirements may be returned within six months after delivery, without penalty and at our risk and expense. You may choose a repair, replacement or refund. We may reasonably assess the reported problem but may not impose repair as the only first remedy or make the right depend solely on our supplier’s approval.
13.4 If we repair goods under that implied warranty and, within three months after the repair, the original problem is not remedied or a further failure, defect or unsafe feature is discovered, the CPA requires replacement or a refund. We will not insist on repeated repairs contrary to that right.
13.5 These periods do not replace an additional warranty or any longer or different right arising under applicable law, including reasonable durability requirements. For an applicable safety recall, follow the recall instructions; required recall remedies are not treated as discretionary returns.
14. Warranty assessment and installation-related damage
14.1 Any additional manufacturer or distributor warranty will be identified in the product information, with its material conditions available before purchase. It supplements, and does not replace, your statutory rights against us. We do not impose an undisclosed universal warranty period on every brand or product.
14.2 A claim may be declined to the extent that the problem was caused by incorrect installation, misuse, accidental damage, unsuitable electrical supply, overloading, water exposure outside the product’s rating, or unauthorised alteration or repair, and the law permits that outcome. We will consider the actual cause rather than treating these examples as automatic exclusions.
14.3 A blown speaker, damaged amplifier, broken seal or modification does not, by itself, prove misuse or defeat every claim. We may request relevant installation details and a technical assessment. If we decline a claim, we will explain the factual and technical reasons and give you a reasonable opportunity to respond or use the dispute process.
14.4 Ordinary wear must be distinguished from premature failure or inadequate durability. Pre-dispatch testing and a manufacturer’s refusal of a claim do not, by themselves, discharge our own legal obligations.
15. Return procedure, verification and substituted goods
15.1 Contact us using clause 24 with your order number or other reasonable proof of purchase, the product details and a description of the problem or reason for return. Include the serial number and supporting photographs where available. A return reference helps us track the matter but is not a precondition to giving a valid statutory cancellation notice.
15.2 We will agree practical return arrangements, including collection where the return is at our expense. Return the actual goods we supplied and the relevant accessories. Use the original packaging where available, or suitable protective packaging. Absence of the original box does not automatically defeat a defect claim. Do not send goods to a manufacturer or unrelated address unless the arrangement has been confirmed.
15.3 We may compare returned goods with serial numbers, identifying marks, test results, photographs and dispatch records. We may refuse a refund or replacement for a different item, substituted components or a counterfeit unit not supplied by us where the evidence reasonably establishes the discrepancy. We will consider recording errors, authorised warranty replacements and your explanation before concluding that goods were substituted.
15.4 Our target is to complete an initial assessment within 10 business days after receiving the goods. If more time is reasonably needed, we will explain why and provide an update. An assessment or supplier referral does not extend a statutory refund deadline or remove your choice of remedy.
15.5 We will not carry out chargeable diagnosis or repairs without first explaining the proposed work and price and obtaining your authority. No fee is payable for handling a valid statutory defect return. A fault not reproduced on the first test is not, by itself, a basis for an undisclosed assessment fee.
15.6 If goods are not eligible for the requested return, we will provide reasons and agree their return or collection. We will not sell, destroy or treat your property as abandoned merely because a dispute remains unresolved. Any remedy for established fraud must be lawful and proportionate.
16. Refunds and exchanges
16.1 Refunds are ordinarily made through the original payment method. Where that is not reasonably possible, we will agree a secure alternative and may verify the recipient’s details. For an instalment purchase, we will coordinate the refund and adjustment with the payment provider. You are not required to accept a voucher or store credit instead of a monetary refund you are legally entitled to receive.
16.2 Our target is to initiate an approved refund within five business days, and always within any applicable legal deadline. In particular, ECTA’s 30-day cooling-off refund period runs from cancellation, not from our assessment or approval. We will not delay a refund due to you until we recover from a supplier, insurer or courier.
16.3 The refund is based on the amount actually paid for the relevant goods, with delivery and return costs dealt with under the applicable right. No automatic percentage deduction applies. Any lawful adjustment will be explained and supported; deductions permitted for one category of return will not be imposed on a different category.
16.4 An agreed exchange for a different product requires agreement on any price difference and delivery arrangements. Statutory replacements and refunds are dealt with under clause 13, not as discretionary exchanges.
17. Promotions, bundles and business purchases
17.1 Promotions apply for the period, products and quantities stated. Material restrictions must be disclosed before purchase. A discount or promotional gift does not remove product-quality rights. A return of a complete promotional bundle should include its supplied components and gifts; any adjustment for a partial return must be lawful and based on the disclosed offer, not an invented penalty.
17.2 Trade prices, quantity discounts and credit facilities apply only where expressly agreed. These terms do not grant an automatic credit account. A separate trade agreement must be accepted before the relevant order and cannot remove a statutory protection that still applies.
17.3 Where genuine parallel-import, reconditioned or second-hand goods are offered, their status and any material difference in warranty arrangements will be disclosed before purchase. We will not describe an aftermarket product as an authorised vehicle-manufacturer product without a proper basis.
18. Website content and customer reviews
18.1 Website designs, text, images and other content belong to us or their respective rights holders. You may use the website and save product and transaction information for legitimate shopping, record-keeping and complaints. Commercial copying or reuse beyond what the law permits requires the relevant permission.
18.2 If you submit a review for publication, you permit us to display it and make necessary formatting changes without altering its meaning. Do not submit unlawful content, another person’s private information or material you have no right to use. We may moderate on those grounds, but will not suppress a genuine complaint merely because it is critical or require removal of a review as a condition of a statutory remedy.
19. Responsibility and limitations of liability
19.1 Nothing in these terms excludes or limits liability for fraud, wilful misconduct, gross negligence, a mandatory product-liability claim, failure to meet legally required payment-security duties, or any other liability that may not lawfully be excluded or limited. Your entitlement to a refund or other mandatory remedy is not capped by this clause.
19.2 For a transaction protected by consumer law, our responsibility is determined by that law and the agreement. We do not impose a blanket purchase-price cap on claims for personal injury or damage to other property caused by defective goods.
19.3 Only for business purchases to which the CPA’s consumer-contract protections and ECTA’s consumer-protection provisions do not apply: subject to clause 19.1 and applicable law, we are not liable for indirect or consequential loss, including loss of profit or business interruption, and our aggregate liability in connection with the affected order is limited to its total purchase price paid or payable. This does not limit an obligation to return money or property that belongs to you.
19.4 Each party must take reasonable steps to avoid or reduce loss. An allegation that the other party failed to do so does not authorise withholding an undisputed statutory remedy.
20. Events outside reasonable control
20.1 If an event outside our reasonable control materially prevents performance, we will notify you, take reasonable steps to reduce its effect and explain the revised position. This is not an automatic exemption for ordinary stock-management problems or every courier delay.
20.2 Any relief from performance is limited to what the law permits and lasts only while the event actually prevents it. Agreed cancellation rights, statutory delivery rights and obligations to refund money remain available. We will not retain payment indefinitely for goods we cannot supply.
21. Privacy, communications and transaction records
21.1 Our separate Privacy Notice explains the information we collect, the purposes and lawful grounds for processing, necessary sharing with service providers, security measures, retention and your rights. Information needed to process an order, arrange delivery, prevent fraud or handle a claim is not a licence to use your information for unrelated purposes.
21.2 Accepting these terms is not consent to optional marketing. Marketing subscription is separate and voluntary, with an unsubscribe facility. We may send necessary order, delivery, safety and service communications without treating them as optional advertising.
21.3 Payment is processed through the providers identified at checkout using security procedures explained in the Privacy Notice and payment information. We will use a payment system meeting applicable legal security requirements. Do not send full card details or banking credentials through ordinary messaging channels.
21.4 You may save or print these terms and the order information before purchase. We will send transaction confirmation electronically. Copies of transaction records and the terms applicable to your order may be requested from our support contact for five years after the transaction, subject to reasonable identity verification. Retention beyond that period is governed by applicable legal requirements and our Privacy Notice; it does not enlarge our right to use personal information.
22. Complaints and dispute resolution
22.1 Please first contact our complaints contact in clause 24 with the order details, relevant facts and remedy sought. Our target is to acknowledge the complaint within two business days and provide a substantive response within 10 business days, or explain the next steps and expected timing. These targets do not extend a statutory deadline.
22.2 For matters within its scope, the South African Automotive Industry Code of Conduct applies and an unresolved complaint may be referred to the Motor Industry Ombudsman of South Africa (MIOSA). MIOSA may be contacted on 010 590 8378 or at info@miosa.co.za; its complaint procedure and the Code are available at https://miosa.co.za/.
22.3 You retain access to the appropriate ombud, the National Consumer Commission, a competent regulator or tribunal and the courts, in accordance with applicable jurisdiction and any legally required dispute-resolution steps. A non-automotive product complaint may fall within another ombud’s jurisdiction. These terms do not impose compulsory private arbitration or require a consumer to litigate exclusively in a distant court.
22.4 South African law governs these terms and the sale, subject to mandatory protections that cannot lawfully be displaced.
23. Changes, notices and general provisions
23.1 We may update these terms for future orders by publishing a dated version. The version presented when you order governs that order. An update does not retrospectively reduce an existing right or alter an accepted order without your agreement.
23.2 Send contractual notices to the contact details in clause 24 and use the physical address stated there for formal legal service where applicable. Keep your contact details current. Receipt and validity of electronic notices are governed by applicable law; a failed or bounced message is not automatically treated as read.
23.3 If a provision is unenforceable, it will be severed or limited only to the extent legally permissible without defeating the lawful purpose of the agreement. The remaining provisions continue to apply. A reasonable indulgence is not a waiver of a right.
23.4 These terms do not exclude a representation, undertaking or right that the law requires to remain effective. We will not transfer our obligations in a way that unlawfully reduces your protection.
24. Seller and contact information
24.1 The following details identify the seller and the channels for orders, returns, complaints, privacy enquiries and formal notices. The Privacy Notice and any additional product warranty must remain accessible before purchase.
